Terms and Conditions

Article 1 (Formation of Contract)

  1. The rental member refers to the individual who, after the prescribed confirmation procedure based on the application for rental services, has been accepted by Xmobile Inc. (hereinafter referred to as "the Company").
  2. The rental member may receive rental services for rental products (hereinafter referred to as "the Product") from the Company.
  3. In case of renting, the details of the product will be listed in the invoice or delivery note.
  4. The rental member agrees to the Company's "Rental Terms and Conditions" and may apply for rental services based on this agreement.

Article 2 (Handling of Personal Information)

The Company will use the rental member's personal information for the purpose of concluding rental contracts between the member and the Company, preserving and managing rights, exercising rights, providing rental services, and after-service related to the rental contract. The rental member agrees to this use.

Article 3 (Warranty Liability)

The Company only guarantees that the product has normal functionality at the time of delivery. The Company does not guarantee the merchantability of the product or its suitability for the rental member's intended use. If the rental member does not notify the Company about any defects within 2 days after receiving the product, the product will be considered to have been delivered in a fully functional condition.

Article 4 (Exemption from Liability)

  1. The Company will not be held responsible for any delay or inability to deliver the product due to natural disasters, power restrictions, transportation accidents, labor disputes, supplier defaults, or other events beyond the Company's control.
  2. In the event of damage caused by the rental member's use or storage of the product, the rental member will handle the matter at their own responsibility, and the Company will not be held responsible.
  3. If the Company is liable for damages in individual transactions, the liability will be limited to the direct damages incurred by the rental member, up to the equivalent of the rental fee for that specific contract.The Company will not be held responsible for indirect damages, special damages, or consequential damages (such as delays in work, waiting time, lost profits, lost opportunities, or damage expansion).

Article 5 (Rental Period)

The rental period will be as specified in the invoice or delivery note. The rental member must return the product or initiate return procedures within the rental period.

  1. Extensions of the rental period can only be made if the rental member contacts the Company during the rental period and the Company approves the extension.
  2. If the product is returned after the due date without prior extension notice, the rental member will be required to pay a separate late fee.
    The rental fee for the extended period will be determined based on the extended rental period.
  3. If the rental period is exceeded without notice, the Company may suspend services and enforce termination of the contract.

Article 6 (Limitations on Rental Quantity)

As a general rule, individual rental members are allowed to rent only one unit, and corporate rental members may be subject to limitations based on the company's size or other factors.
The rental member agrees that the rental quantity may be limited due to product availability, and no objections will be raised.

Article 7 (Rental Fees)

The rental fee will be as specified in the invoice or delivery note, based on the rental period.

Article 8 (Payment Method)

For individual rental members, rental fees (including shipping fees and taxes) must generally be paid in advance via credit card.

For corporate rental members, payment can be made by credit card or bank transfer in advance, but if there is no company website or insufficient information, or if the email address is a free email address, payment must be made in advance via credit card.
(Please note that payment information such as credit card details will be handled directly by a payment service provider, and the Company does not store such payment information.)

If payment is made via post-payment, it will generally be billed at the end of the rental start month, with payment due at the end of the following month.
If a separate payment method has been agreed upon, it will take precedence.

If additional fees, such as call charges or service usage fees, arise, the Company will deduct the total from the credit card. If payment is made via bank transfer, the rental fee and additional charges will also be paid together.

If the rental member transfers fees to the Company’s bank account or receives a deposit refund, the transfer fees will be borne by the rental member.

Article 9 (Early Termination)

  1. If the product is returned before the end of the rental period, no partial refund or discount on the rental fee will be provided.
  2. In the case of long-term contracts based on quotes, the terms of the contract will apply.

Article 10 (Product Maintenance)

  1. The Company may request regular checks or reports on the condition of the product from the rental member.
  2. The rental member is responsible for maintaining the Company's property sticker attached to the product.
  3. The rental member may not transfer, sublet, pledge, or set any security interest on the product without the Company’s consent.
  4. The rental member must immediately notify the Company if the product is seized or faces legal or factual infringement from a third party.
  5. The rental member may not modify or alter the product without the Company’s approval.
  6. The Company will not be responsible for any damages arising from trouble after the product has been delivered.
  7. If accounts or passwords are set on rental devices, they must be removed before returning. If removal is not possible, the rental member must compensate for the device based on its market price.
  8. The rental member must promptly notify the Company of any changes to the registered address or other contact information.

Article 11 (Loss or Damage to Product)

  1. If the product is lost or damaged (excluding normal wear and tear) during the rental period, the rental member will bear the full cost of repair or replacement with an equivalent product. If the rental member has subscribed to the "あんしん補償" (Peace of Mind Compensation) service, a specified amount will apply.
  2. The compensation covers repairable issues such as breakage or water damage. For issues that cannot be repaired, such as internal LCD failure or software problems, the rental member will be responsible for compensation.
  3. If the product is lost or stolen, or if damage occurs due to a natural disaster, the rental member must report it to the Company without delay.

Article 12 (Contract Termination)

  1. If the rental member violates any of the above terms or if the Company deems it necessary for the protection of its claims, the Company may request the return or collection of the product without notice, and may terminate the rental contract.
  2. If the Company requests the return of the product, the rental member must immediately return the product.
  3. For cancellations after application, the following cancellation fees will apply:
    More than 10 days before rental start: Free
    Less than 10 days before rental start: 50% of rental fee (including options and taxes)
    On the day of rental start: 100% of rental fee (including options and taxes)

Article 13 (Prohibited Actions)

  1. The contract and users may not transfer calls or configure forwarding settings on rented devices or rental mobile lines.
  2. The contract and users may not remove SIM cards from rented devices for use in other communication devices.
  3. The contract and users may not change communication settings or connections on rented devices.
  4. Contractors and users, particularly unregistered corporate entities, may not resell the Company's rented communication devices to individuals.

Article 14 (Jurisdiction)

In the event of a legal dispute related to this contract, the Tokyo District Court shall have exclusive jurisdiction.

Article 15 (Matters for Discussion)

If any matters arise that are not covered by these Terms and Conditions, or if there is any doubt regarding the interpretation of these Terms, the Company and the rental member shall consult each other and make every effort to resolve the issue.

Article 16 (Matters Outside the Terms)

If there are separate agreements between the Company and the user, those agreements will take precedence over these Terms.
